Terms & Conditions of Sale
1. Introduction
These Terms & Conditions govern the sale of modular cabins and related products by [Company Name] (“we”, “us”, “our”) to consumers (“you”, “your”).
By accepting a quotation and paying a deposit, you agree to be bound by these Terms.
2. Nature of Products
All modular units are manufactured to order based on your selected specifications. As such, products are custom-made and may not be suitable for resale.
3. Order Process & Contract Formation
A binding contract is formed only when:
- you accept our written quotation;
- you accept these Terms & Conditions; and
- we receive the required deposit.
Until this point, quotations and discussions are non-binding.
4. Payment Terms
Payment is structured as follows:
- 50% deposit to secure your order and initiate design, administration, and scheduling
- 25% payable prior to shipping / dispatch
- 25% payable upon delivery
If you choose to:
- pay in full upfront, or
- use third-party finance,
full payment may be required in advance, as agreed in writing.
5. Specification Approval
You must confirm final specifications in writing before production begins.
This confirms that:
- the unit is being manufactured to your specific requirements;
- it may not be suitable for resale;
- you accept that cancellation rights may be limited once production begins.
6. Cooling-Off Period (Consumer Cancellation Rights)
6.1 Your Right to Cancel
You have the right to cancel your order within 14 days of entering into the contract, without giving a reason.
6.2 When the Cooling-Off Period Ends Early
Due to the custom-made nature of our products, your right to cancel will end if:
- you approve the final design/specification; and
- we begin production (including ordering materials or allocating manufacturing capacity).
By approving your specifications, you expressly acknowledge and agree to this.
6.3 Cancellation Within Cooling-Off Period
If you cancel within 14 days and production has not begun:
- you are entitled to a refund of your deposit
- we may deduct reasonable costs already incurred, including:
- design work
- administration
- planning and scheduling
All deductions will be fair and proportionate.
6.4 Cancellation After Cooling-Off Period
After the cooling-off period has expired, or once production has begun:
- the contract becomes binding
- cancellation is not guaranteed
- refunds will only be considered in exceptional circumstances, at our discretion
Any refund will reflect costs already incurred, including materials, labour, and production commitments.
7. Production & Custom-Made Status
Once production has commenced, your order is treated as a custom-made product under applicable consumer law, and standard cancellation rights no longer apply.
8. Delivery
- The anticipated delivery timeframe is approximately 16 weeks from final specification approval
- This timeframe is an estimate and may vary due to:
- production demand
- material availability
- supply chain conditions
- weather
- site readiness
We will make reasonable efforts to meet timelines but cannot guarantee delivery dates.
9. Site Responsibility
You are responsible for ensuring:
- safe and adequate access for delivery
- suitable foundations or base
- compliance with planning permissions and local regulations
We are not responsible for delays or additional costs arising from site conditions or lack of preparation.
10. Inspection & Acceptance
You must inspect the unit upon delivery.
Any issues must be reported within 5 working days of delivery.
11. Faulty or Non-Conforming Goods
Nothing in these Terms affects your statutory rights under Irish and EU law.
If goods are:
- faulty
- not as described
- not of satisfactory quality
you are entitled to remedies in accordance with applicable consumer protection legislation.
12. Force Majeure (Events Beyond Our Control)
We shall not be liable for any delay or failure to perform our obligations where this is caused by events beyond our reasonable control, including but not limited to:
- acts of God (e.g. storms, floods, natural disasters)
- war, terrorism, or civil unrest
- fire or industrial accidents
- pandemics or public health emergencies
- government actions or restrictions
- labour shortages or strikes
- supply chain disruption or material shortages
In such circumstances, we may suspend or delay performance without liability.
13. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for:
- indirect or consequential losses
- loss of profit, business, or opportunity
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- your statutory consumer rights
14. Eligibility
You must be at least 18 years of age to place an order.
15. Governing Law
These Terms & Conditions are governed by the laws of Ireland.
